God sees all, knows all, and allows what He will. Again, God established capital punishment, not man. He also had special laws that dealt with harm brought upon a pregnant woman and/or her unborn child. When God said "Thou shalt not kill", it was understood that to defend themselves from the enemy and from wrongdoers in their midst, killing was necessary. They also understood that it meant they could not murder someone or their life would be forfeit.
There is a difference between the two acts, and the difference was clarified long before the Supreme Court stuck its nose in it.
